1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Kvizum d.o.o., a company registered in Slovenia, operating the SendBrake service ("we", "us", "our", "SendBrake").

By accessing or using SendBrake at sendbrake.com, creating an account, or subscribing to any plan, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

If you are using SendBrake on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. The Service

SendBrake is a B2B SaaS platform that automatically suppresses company domains in cold email sequencers when a prospect books a meeting through a connected booking tool. The Service connects to third-party booking sources and email sequencers via API integrations.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. We will provide reasonable advance notice of material changes where possible.

SendBrake is intended solely for business use by professionals engaged in outbound sales or email marketing. It is not intended for consumer use.

3. Accounts & Registration

To use SendBrake you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate registration information and keep it updated.
• Not share your account credentials with unauthorised parties.
• Notify us immediately at support@sendbrake.com if you suspect any unauthorised access to your account.
• Be solely responsible for all activity conducted through your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Subscriptions & Billing

SendBrake is offered on a subscription basis. By selecting a plan, you authorise us to charge your payment method on a recurring basis (monthly or annually, depending on your chosen billing cycle) until you cancel.

Subscription fees are charged in advance at the start of each billing period. All prices are listed in US Dollars (USD) and exclude any applicable taxes, which are your responsibility.

We use a third-party payment processor (such as Stripe) to handle payments. By subscribing, you agree to that processor's terms of service. We do not store your full payment card details.

We reserve the right to change subscription prices. Where we increase prices, we will give you at least 30 days' advance notice. Continued use of the Service after the notice period constitutes acceptance of the new pricing.

5. Refunds & Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at support@sendbrake.com. Cancellation takes effect at the end of your current billing period.

Upon cancellation:

• Your subscription will remain active and fully functional until the end of the paid billing period.
• You will not be charged again after the current period ends.
• Access to the Service will cease at the end of the billing period unless you resubscribe.
• No refund will be issued for any remaining days in the billing period.

If you subscribed during a free trial, cancelling before the trial ends will not result in any charge.

Notwithstanding the above, if you are a consumer resident in the European Union, you may have additional rights under applicable EU consumer protection laws. Please contact us to discuss your situation.

6. Acceptable Use

You agree to use SendBrake only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service to send unsolicited communications in violation of applicable laws (including GDPR, CAN-SPAM, or CASL).
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Use the Service to transmit malware, viruses, or other harmful code.
• Attempt to gain unauthorised access to any systems or networks connected to the Service.
• Resell, sublicense, or otherwise commercialise access to the Service without our written consent.
• Use the Service in any way that could bring SendBrake or Kvizum d.o.o. into disrepute.

We reserve the right to investigate suspected violations and to suspend or terminate accounts found to be in breach of this section.

7. Intellectual Property

All content, software, trademarks, logos, and materials comprising the SendBrake Service are the exclusive property of Kvizum d.o.o. or its licensors, protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your internal business purposes during the subscription term.

You retain ownership of any data you input into the Service ("Customer Data"). By using the Service, you grant us a limited licence to process your Customer Data solely to provide the Service to you.

8. Third-Party Integrations

SendBrake connects to third-party platforms including booking tools (such as Calendly, Cal.com, GoHighLevel, HubSpot, Pipedrive) and email sequencers (such as Instantly, Smartlead, Lemlist, Saleshandy, EmailBison, Woodpecker). These integrations are provided as a convenience.

We are not responsible for the availability, accuracy, or reliability of any third-party service. Changes to third-party APIs may affect SendBrake functionality; we will endeavour to maintain integrations but cannot guarantee uninterrupted compatibility.

Your use of third-party services is governed by their respective terms of service and privacy policies. We encourage you to review those policies.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Kvizum d.o.o. disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• Suppression actions will occur instantaneously in all cases.
• The Service will meet your specific business requirements.
• Any errors in the Service will be corrected.

You acknowledge that cold email outreach is subject to applicable laws and regulations in your jurisdiction. You are solely responsible for ensuring that your use of the Service complies with all applicable laws.

10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Kvizum d.o.o., its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, business, or goodwill — arising out of or in connection with your use of the Service.

Our total aggregate liability to you in respect of any claims arising under or in connection with these Terms shall not exceed the total fees paid by you to SendBrake in the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the greatest extent permitted by law.

11. Termination

You may terminate your account at any time by cancelling your subscription and ceasing use of the Service. Termination does not entitle you to any refund.

We may suspend or terminate your account immediately, without prior notice, if:

• You breach any provision of these Terms.
• We are required to do so by law or court order.
• We reasonably believe your use poses a risk to the Service, other users, or third parties.

Upon termination, your right to access the Service ceases immediately (or at end of billing period for voluntary cancellations). Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Slovenia. If you are a consumer in the EU, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must cancel your subscription and stop using the Service before the effective date.
